Specifically, this guidance defines e-cigarettes as a law enforcement priority, largely due to the growing usage by minors. However, this guidance is widely interpreted to affect tobacco and nicotine e-cigarettes, and since Delta-8 vapes are free of nicotine, sellers and manufacturers have inferred that they’re not directly affected by this law.
